WI Electronics Recycling Law - Retailer Requirements Begin July 1,2010

In October 2009, the Wisconsin Electronics Recycling Law was passed, establishing a collection and recycling system in Wisconsin for certain consumer electronic devices discarded by households and K-12 public schools, and bans landfilling or incineration of these devices in Wisconsin.

Wisconsin's electronics recycling law assigns primary responsibility for collection and recycling of products to the manufacturer. In Wisconsin, manufacturers of covered electronic devices (CEDs) (including computers, televisions, printers and certain video display devices) will be responsible for financing and ensuring the recycling of these and other electronic devices within the state.

This law imposes a number of requirements on manufacturers of consumer CEDs. Under the law beginning February 1, 2009, a manufacturer may not sell a CED to a Wisconsin household or K-12 public school through direct sale, at retail or to a retailer for resale, unless it:

1. Registers with the Department of Natural Resources (DNR)
2. Arranges for the collection and recycling of eligible electronic devices.
3. Submits required reports
4. Pays certain fees

Beginning July 1, 2010, the law prohibits a retailer from selling a CED unless the retailer, using an Internet site maintained by the DNR, determines that the manufacturer is registered.
